Terms of Service

Version 2026-10-draft-1

1. Agreement

These Terms govern your use of CLEARED Hub (the "Service"), operated by [LEGAL ENTITY NAME, STATE] ("we"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If your school or program (a "Program") has signed a separate agreement with us, that agreement controls where it conflicts with these Terms.

2. What the Service is — and is not

CLEARED collects daily athlete check-ins and staff-entered training and injury information, applies fixed, documented rules to produce a daily readiness status and a written recommendation, and shows them to the athlete's own staff. It is a wellness and training-load tool. It is not a medical device, does not diagnose or treat any condition, and does not clear or restrict any athlete from participation. Decisions about training, medical care, and return to play belong to the Program's coaches, certified athletic trainers, and physicians. The optional Coach's Assistant is an AI feature that can be wrong; see our AI Use & Product Limits notice.

3. Eligibility and accounts

  • You must be invited by a Program (by invite code) or be a Program's staff member.
  • Athletes under 18 may use the Service only after a parent or guardian consents through the Program. Children under 13 may not use the Service.
  • You are responsible for keeping your password secure and for activity under your account. Tell us right away if you think your account was accessed without permission.
  • One person per account. Do not share logins.

4. Responsibilities

Athletes: answer check-ins honestly; keep reporting pain, injury, or illness directly to your athletic trainer — CLEARED is not a substitute for that.

Coaches and staff: use athlete data only to support the athletes' training and well-being within your Program; review flagged athletes yourself and involve your athletic trainer or physician for any health concern; enter accurate roster, session, and injury information; do not use CLEARED data as the sole basis for decisions about an athlete's roster spot, scholarship, or playing time.

Athletic trainers: you remain responsible for clinical judgment and for keeping official medical records in your Program's own system of record. CLEARED injury notes are not a medical record system.

Program administrators: make sure athletes are told how their data is used, obtain any required parent/guardian consent, manage who has staff access, and remove staff who leave.

5. Acceptable use

You may not: access data of a team you do not belong to; try to bypass access controls, rate limits, or anti-bot checks; scrape or reverse-engineer the Service; enter false data; upload malicious code; use the Coach's Assistant to seek or record medical diagnoses; or use the Service for recruiting other schools' athletes, wagering, or any unlawful purpose.

6. Your content and data

You and your Program keep ownership of the data you enter. You give us permission to store and process it only to provide the Service, as described in the Privacy Policy and any Program agreement. We may use de-identified, aggregated statistics that cannot reasonably identify any athlete or Program to operate and improve the Service. [Counsel: confirm this de-identified-use clause is acceptable under FERPA and the Program agreement, or remove.]

7. Our intellectual property

The Service, its software, scoring rules, design, and the CLEARED name and logo belong to us. We grant you a limited, non-exclusive, non-transferable right to use the Service for your Program's internal purposes while your account is active.

8. Beta status and availability

The Service is in beta. Features may change or be removed. We do not guarantee any level of uptime and depend on third-party providers (hosting, database, email, AI). We may suspend the Service for maintenance or security. A Program's access may also end on the expiration date in its agreement.

9. Fees

Pilot access is provided [free of charge / under the Program agreement]. Paid terms, if any, are in the Program agreement.

10. Ending your use

You can stop using the Service at any time. Athletes can erase their data from account settings; anyone can ask us to delete their login. We may suspend or end an account that breaks these Terms or puts others' data at risk. When a Program's agreement ends, its data is handled as that agreement and our Retention Policy describe.

11. Disclaimers

[COUNSEL TO DRAFT.] The Service is provided "as is" and "as available." To the extent the law allows, we disclaim implied warranties, including fitness for a particular purpose and accuracy of any status, recommendation, or AI answer.

12. Limitation of liability

[COUNSEL TO DRAFT — must consider enforceability where athlete health and safety are involved, Nebraska law, and whether a public or private institution is the counterparty.]

13. Indemnity

[COUNSEL TO DRAFT — consider whether to require indemnity from individual athletes at all; it is unusual and may be unenforceable or harmful to adoption.]

14. Governing law and disputes

[COUNSEL TO DRAFT — proposed: laws of the State of [Nebraska / entity's state], courts of [county]; note that a public institution may not accept this.]

15. Changes to these Terms

We will post a new version with a new date and ask you to accept it the next time you sign in. If you do not accept, stop using the Service.
